Searches: Searches make possible the obtainment of results in a very short time, reviewing several data bases and including legal opinions with effective alternative actions. Trademark and Trade Slogan Registrations: Before we file an application, we make a previous study of the proposed rademark (besides the search) to corroborate the viability of the registration of the same. This includes visits and reviews of the physical files in the Trademark Office, when necessary.
The trademark applications and registrations are managed with our own database, TUMNET. This database also surveys the registrations during its validity in the Official Gazettes of Colombia, Bolivia, Ecuador, Perú, Venezuela and Panamá, among others. Permanent surveillance is free of charge.
Before the expiration of the registration, its owner is properly notified to determine if sign wants to be renewed or not.
Deposit of Commercial Names and Trade Emblems: Even when rights in these cases are acquired by use, TRIANA, URIBE & MICHELSEN proceeds with the deposits of the trade names and trade emblems, depending on the client's specific needs, if required.
Oppositions: We carry out a study of the opposed distictive sign in order to verify the grounds of the opposition, as well as its chances of success. In occasions, when needed, the file or the necessary issues are verified before the Trademark Office in order to collect all the necessary information for the client to achieve its objetives without additional costs.
The filed writs are well grounded in arguments to convince the administrative authorities, and to insist before the Council of State (Consejo de Estado) if the outcome is not favorable. Our recommendations always explain and support the success possibilities in the procedures.
Action for non-use or Notoriety: Our legal service makes easier for the clients to get the necessary evidence for the case, carrying out the corresponding research. We also provide continued assistance, which includes visiting the clients' installations in order to determine what evidence is appropriate in case that the action for non-use is presented against them.
Licenses and Register Affectation: In order to minimize contingencies for the client, we review the contractual matters before the inscription. This task goes as far as the effective and correct recordal.
